Commitments

If, during proceedings under Article 75a(2), the operator concerned offers commitments to ensure compliance with the relevant provisions of this Regulation, the AI Office may, by decision, make those commitments binding on the operator concerned and declare that there are no further grounds for action. The AI Office may, upon request or on its own initiative, reopen the proceedings where:

(a)	there has been a material change in any of the facts on which the decision was based;
(b)	the operator acts contrary to its commitments; or
(c)	the decision was based on incomplete, incorrect or misleading information provided by the operator concerned.

Where the AI Office considers that the commitments offered by the operator concerned are unable to ensure effective compliance with the relevant provisions of this Regulation, it shall reject those commitments in a reasoned decision when concluding the proceedings.

Se, nel corso di un procedimento a norma dell'articolo 75 bis, paragrafo 2, l'operatore interessato offre di assumersi impegni volti a garantire la conformità alle pertinenti disposizioni del presente regolamento, l'ufficio per l'IA può, mediante decisione, rendere tali impegni vincolanti per tale operatore e dichiarare che non vi sono ulteriori motivi di intervento. L'ufficio per l'IA, su richiesta o di propria iniziativa, può riaprire il procedimento qualora:

a)	si sia prodotto un cambiamento sostanziale di uno dei fatti su cui si è fondata la decisione;
b)	l'operatore agisca in contrasto con i propri impegni; oppure
c)	la decisione sia stata fondata su informazioni incomplete, inesatte o fuorvianti trasmesse dall'operatore interessato.

Se ritiene che gli impegni offerti dal fornitore interessato non siano idonei a garantire l'effettiva conformità alle pertinenti disposizioni del presente regolamento, l'ufficio per l'IA respinge tali impegni in una decisione motivata al momento della conclusione del procedimento.
