Commitments

If, during proceedings under Article 75a(2), the operator concerned offers commitments to ensure compliance with the relevant provisions of this Regulation, the AI Office may, by decision, make those commitments binding on the operator concerned and declare that there are no further grounds for action. The AI Office may, upon request or on its own initiative, reopen the proceedings where:

(a)	there has been a material change in any of the facts on which the decision was based;
(b)	the operator acts contrary to its commitments; or
(c)	the decision was based on incomplete, incorrect or misleading information provided by the operator concerned.

Where the AI Office considers that the commitments offered by the operator concerned are unable to ensure effective compliance with the relevant provisions of this Regulation, it shall reject those commitments in a reasoned decision when concluding the proceedings.

Si, au cours d'une procédure dans le cadre de l'article 75 bis, paragraphe 2, l'opérateur concerné s'engage à veiller au respect des dispositions pertinentes du présent règlement, le Bureau de l'IA peut, par une décision, rendre ces engagements contraignants pour l'opérateur concerné et déclarer qu'il n'y a plus lieu d'agir. Le Bureau de l'IA peut rouvrir la procédure, sur demande ou de sa propre initiative, lorsque:

a)	l'un des faits sur lesquels la décision repose subit un changement important;
b)	l'opérateur agit contrairement à ses engagements; ou
c)	la décision repose sur des informations incomplètes, inexactes ou trompeuses fournies par l'opérateur concerné.

Si le Bureau de l'IA estime que les engagements proposés par l'opérateur concerné ne permettent pas de garantir le respect effectif des dispositions pertinentes du présent règlement, il rejette ces engagements dans une décision motivée lors de la clôture de la procédure.
