The AI Office may now request documentation, order a model's withdrawal and impose fines

Together with the AI Act becoming generally applicable on 2 August 2026, the Commission and the AI Office also gained a set of tools with which to supervise providers of general-purpose AI models. Under Article 91 the Commission may request the documentation drawn up under Articles 53 and 55 as well as any other information necessary to assess compliance. Before such a request is sent, the AI Office may enter into a structured dialogue with the provider. Under Article 92 the AI Office may evaluate a general-purpose AI model, under Article 93 the Commission may request measures – from risk mitigation to restricting the making available of the model on the market, its withdrawal from the market or its recall – and under Article 101 impose fines. Before adopting a decision on a fine the Commission must communicate its preliminary findings to the provider and give it an opportunity to be heard; a decision imposing a fine is subject to unlimited review by the Court of Justice, which may annul, reduce or increase it.
