Without prejudice to applicable Union law, in particular Regulation (EU) 2016/679 and Directive (EU) 2016/680, considering the intrusive nature of post-remote biometric identification systems, the use of post-remote biometric identification systems should be subject to safeguards. Post-remote biometric identification systems should always be used in a way that is proportionate, legitimate and strictly necessary, and thus targeted, in terms of the individuals to be identified, the location, temporal scope and based on a closed data set of legally acquired video footage. In any case, post-remote biometric identification systems should not be used in the framework of law enforcement to lead to indiscriminate surveillance. The conditions for post-remote biometric identification should in any case not provide a basis to circumvent the conditions of the prohibition and strict exceptions for real time remote biometric identification.

Sin perjuicio del Derecho de la Unión aplicable, en particular el Reglamento (UE) 2016/679 y la Directiva (UE) 2016/680, teniendo en cuenta el carácter intrusivo de los sistemas de identificación biométrica remota en diferido, el uso de este tipo de sistemas debe estar sujeto a garantías. Los sistemas de identificación biométrica remota en diferido deben utilizarse siempre de manera proporcionada y legítima, en la medida de lo estrictamente necesario y, por ende, de forma selectiva por lo que respecta a las personas que deben identificarse, la ubicación y el alcance temporal y a partir de un conjunto limitado de datos de grabaciones de vídeo obtenidas legalmente. En cualquier caso, los sistemas de identificación biométrica remota en diferido no deben utilizarse en el marco de la garantía del cumplimiento del Derecho de tal forma que se produzca una vigilancia indiscriminada. Las condiciones para la identificación biométrica remota en diferido en ningún caso deben servir para eludir las condiciones de la prohibición y las estrictas excepciones aplicables a la identificación biométrica remota en tiempo real.
