Save for a few exceptions the AI Act becomes applicable, and the Commission starts enforcing the rules

From 2 August 2026 the AI Act becomes applicable save for a few remaining exceptions. Alongside the transparency obligations under Article 50, Article 101, for instance, now also applies. Under it the Commission may impose fines on providers of general-purpose AI models of up to 3 % of total worldwide annual turnover or EUR 15 million, whichever is higher, not only for breaching substantive obligations but also for failing to comply with a request for information under Article 91, for not complying with a measure requested under Article 93, or for refusing access to a model for evaluation under Article 92. The obligations for high-risk AI systems, by contrast, do not yet apply from 2 August 2026 – the Digital Omnibus deferred them to 2 December 2027 (Annex III) and 2 August 2028 (Annex I). Providers of general-purpose AI models placed on the market before 2 August 2025 also have until 2 August 2027 to comply, under Article 111(3).
